3. Eligibility

You must be at least 18 years of age to use our services or purchase a policy. By using our website, you represent and warrant that you meet this requirement. If you are enrolling dependants under the age of 18, you confirm that you are their parent or legal guardian and have authority to act on their behalf.

4. Account Registration and Security

To access certain features (member portal, provider portal, intermediary portal), you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and not share your credentials with others.
  • Notify us immediately of any unauthorised use of your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

5. Insurance Policy Terms

Your international health insurance policy is governed by the specific policy documents, schedule of benefits, and certificate of insurance issued to you at enrolment. These Terms of Use govern your use of our website and digital services only. In the event of any conflict between these Terms and your policy documents, your policy documents shall prevail with respect to insurance coverage matters.

Key points regarding your policy:

  • Coverage is subject to the terms, conditions, exclusions, and limits set out in your policy schedule.
  • Pre-existing conditions may be subject to exclusions or waiting periods as specified in your policy.
  • Claims must be submitted in accordance with the claims procedure outlined in your policy documents.
  • Premium payments must be made on time to maintain active coverage.

6. Payments and Billing

By enrolling in a plan and providing payment information, you authorise Globalwide Health to charge the applicable premium according to your selected payment frequency (annual, semi-annual, quarterly, or monthly). You agree that:

  • All fees are stated in US Dollars (USD) unless otherwise specified.
  • Payment surcharges apply to non-annual payment frequencies as disclosed at enrolment.
  • Premiums are non-refundable except as required by applicable law or as stated in your policy.
  • We use third-party payment processors and do not store full payment card details on our servers.
  • Failure to pay premiums on time may result in suspension or cancellation of your coverage.

You agree not to use our website or services to:

  • Submit false, fraudulent, or misleading information in any application, claim, or communication.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorised access to any part of our systems or another user's account.
  • Transmit any malware, viruses, or other harmful code.
  • Scrape, crawl, or harvest data from our website without prior written consent.
  • Use our services for any unlawful purpose or in violation of any applicable law or regulation.
  • Interfere with or disrupt the integrity or performance of our website or services.

We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions.

8. Intellectual Property

All content on this website — including text, graphics, logos, icons, images, audio clips, digital downloads, and software — is the property of Globalwide Health or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from this website without our prior written consent.

The Globalwide Health name, logo, Smart Health Card mark, and related marks are trademarks of Globalwide Health. Nothing in these Terms grants you any right to use our trademarks.

9. Third-Party Links and Services

Our website may contain links to third-party websites or integrate third-party services (such as payment processors, mapping services, or communication tools). These links are provided for your convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party site or service. Your use of third-party sites is at your own risk and subject to their respective terms.

10. Medical Disclaimer

The information on this website is provided for general informational purposes only and does not constitute medical advice. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. In a medical emergency, contact local emergency services immediately.

Coverage decisions are made in accordance with your policy terms and are not medical recommendations. Pre-authorisation approval does not guarantee payment if the claim does not meet policy conditions.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Globalwide Health and its officers, directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our website or services — including but not limited to loss of data, loss of revenue, or loss of coverage — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of our website shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of Warranties

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Indemnification

You agree to indemnify, defend, and hold harmless Globalwide Health and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your violation of any rights of another person or entity.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Colorado Springs, Colorado, in accordance with the rules of the American Arbitration Association.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect intellectual property rights or confidential information.

15. Termination

We reserve the right to suspend or terminate your access to our website and services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and your insurance policy documents, constitute the entire agreement between you and Globalwide Health with respect to your use of our website and services, and supersede all prior agreements and understandings.
